Course Description

This course examines the rules of civil procedure that include commencement of proceedings, alternative dispute resolution procedures and service of process. You will study joinder of claims, pleadings, group and representative actions, discovery and other interlocutory proceedings, judgment, enforcement, appeals, and costs. You will also learn about case management systems. You will participate in a moot court and practice drafting skills.

Program Learning Outcomes
In this course you will develop the following program learning outcomes:

  • Use strategic, critical, creative, and analytical thinking to develop creative solutions to a range of dynamic problems associated with crime management and the justice system
  • Employ a wide range of research tools, methods and approaches in the investigation of justice related problems
  • Use appropriate ethical ideas and reflective practice skills in addressing situations and problems in justice settings demonstrating cultural, social and environmental sensitivity
     


Learning outcomes
Upon successful completion of this course, you will be able to:

  1. Analyse and apply the procedural rules of civil litigation in a range of jurisdictions;
  2. Critically evaluate the civil procedure system;
  3. Analyse and apply laws and rules relating to civil procedure to hypothetical situations;
  4. Identify and articulate the challenges in areas of reform such as case management, access to justice and legal ethics concerns.


Overview of Learning Activities

This course is generally delivered in a face-to-face mode with a blend of learning activities, which include lectures, seminars, participating in a Moot Court as part of a team, engaging in legal research, problem solving, guest speakers, presentations, case studies, videos, online activities and student lead discussions.

You will be assessed on how well you meet the course’s learning outcomes and on your development against the program learning outcomes. 

Assessment Tasks

Assessment Task 1:  Research Paper, 50%, CLO1- CLO4

Assessment Task 2:  Take-home examination, 50%, CLO1- CLO4
